THE TUNING SCHOOL LS TUNING PACKAGE PROMOTION OFFICIAL RULES

1. NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.
2. VOID WHERE PROHIBITED. VOID WHERE PROHIBITED AND OUTSIDE THE PROMOTION AREA SET FORTH BELOW.The Tuning  School LS Tuning Package Promotion is intended solely for eligible participants who are attending the 2019 Holley LS Fest  in Bowling Green, Kentucky (“Event Location”) at time of entry. This Promotion will be construed and evaluated only according to applicable laws within the United States. The Promotion begins at or about September 6, 2019 at approximately 8:00 a.m. Eastern Time (“ET”) and ends on September 8, 2019 at or around 4:00 p.m. ET (“Promotion Period”). Following the end of the promotional period, one prize will be awarded as defined below. Please note that, after the prize is awarded, no additional prizes will be awarded.
3. Eligibility:The Promotion is open to legal residents of the 50 United States and the District of Columbia who are at least 18 years of age. Employees of The Tuning School, Inc. (“Sponsor”), HP Tuners, LLC, Nitrous Express, and Daytona Sensors, LLC (and of each of their respective subsidiaries, affiliates, shareholders, officers, directors, agents, representatives and employees) and the immediate family of each such employee, and all individuals (including, but not limited to, consultants, independent contractors, so-called “temporary employees,” former employees and interns) who have, within the past six months, performed services for Sponsor, are not eligible to play or win. “Immediate family” members include spouses, grandparents, parents, children and grandchildren, whether by marriage, past marriages, remarriage, adoption, cohabitation or other family extension. Non-eligibility will result in disqualification.
4. How to Enter:To enter the Promotion, you may do the following at any time during the promotional period:

IN PERSON: Visit The Tuning School booth at 2019 Holley LS Fest. You will be asked to provide basic contact information, including name, address, the phone number, and email (and at which you can be reached) and date of birth.

5. Conditions Applicable to Promotion:Limit one entry per person. All received entry forms become the sole property of Sponsor. Any individual who attempts to play using false contact information or under multiple identities as determined by the Promotion Entities (as defined below), will be disqualified and may be subject to discipline. Lost, delayed, illegible, or incomplete entry forms will be deemed ineligible and disqualified. Sponsor and their respective parents, subsidiaries, and affiliates and all of their directors, officers, employees and agents (collectively, the “Promotion Entities”) are not responsible for late, lost, incomplete, misdirected, stolen, or damaged entry forms or by any human error that may occur in the processing of the entry forms in the Promotion or other failures of any sort, fire, epidemic, explosion, act of God, riot or civil disturbance, war, terrorist threat or activity, any federal, state or local government law, or any other cause not reasonably within Promotion Entities’ control. Promotion Entities are not responsible for printing errors in these Official Rules. By participating in the Promotion, you agree to be bound by these Official Rules and by the decisions of the Promotion Entities, which will be final and binding.
6. Winning:The winning entry form will be hand drawn at random on or about September 8, 2019. If you are a potential winner, you will receive a “winner” message and instructions on how to claim your prize. Limit one prize per person. Non-winning entry forms will not carry over into subsequent promotions.
7. Claiming Prize: Potential prize winner must complete, sign and return an Affidavit of Eligibility, Waiver of Liability or a Prize Acceptance, Eligibility, Liability Release Forms, and except where prohibited by law, Publicity Release Forms the same day of the “winner” message prize notification or prize may be forfeited (TN residents need not sign the publicity releases). The winner must complete Form W-9.

An IRS 1099-MISC Form will be prepared in the winner’s name and submitted to the IRS for the value of the winner’s prize. Sponsor will cause a copy of any submitted 1099-MISC Form to be sent to winner’s last known address. In the event of noncompliance with these Official Rules, if prize notification or attempted notification is returned as undeliverable, if Sponsor does not receive a timely response to prize notification, if prize winner fails to complete and return required documents by deadline set by Sponsor, or if a prize winner declines prize offered, prize will be forfeited, and prize will go un-awarded. By participating in the Promotion, all entrants acknowledge compliance with and agree to be bound by these Official Rules, and the decisions of Sponsor and/or judges, which are final in all respects. The potential prize winner must meet all eligibility requirements set forth in these Official Rules to receive prize. Potential prize winner agrees to accept entirety of the prize. Inability to accept full prize will result in passing on entire prize and forfeiting.

If potential winner does not respond within the timeframe stated in the “winning” message, if potential winner is not in compliance with the Official Rules, if potential winner does not meet the eligibility criteria, or if potential winner does not sign and/or return required documentation by deadline set by Sponsor, prize may be forfeited, and prize will go un-awarded.

8. Odds of Winning:Odds of winning a prize depend on the number of eligible entry forms completed during the promotional period.
9. Prize: One prize will be awarded for this promotion. It will consist of:  (1) HP Tuners MPVI2 GM unit courtesy of HP Tuners, (1) Daytona Sensors Single Channel Wideband, (1) Nitrous Express Purge Kit, (1) Exhaust clamp, (1) Cigarette lighter adapter,  (1) Tuning School 4021- GM HP Tuners printed course, (1) 2-day live seminar seat in January 2020 in Tampa, Florida (date TBA in late-September 2019) and (1) pre-loaded laptop with everything you need to tune GEN III/IV GM's using HP Tuners. Total package valued over $2995.00.

Taxes, if any, are the sole responsibility of the winner. Prize is non-transferable, non-assignable and not redeemable for cash. Only winner may claim prize. Prize details are the sole discretion of Sponsor. Promotion Entities, in their discretion, may substitute a prize (or prize component) of equal or greater value for any reason. Promotion Entities are not responsible for any costs or services that may be required to use the prize, unless specifically included in the prize, including, without limitation, transportation, airfare, lodging, and meals.

10. Termination:If, for any reason (including, without limitation, infection by computer virus, bugs, worms, tampering, unauthorized intervention, fraud, technical failures, or any other cause beyond the reasonable control of the Promotion Entities that corrupts or affects the administration, security, fairness, integrity, or proper conduct of the Promotion), the Sponsor cancels, terminates, modifies or suspends this Promotion, Sponsor will not select prize winner and will close the Promotion. If Sponsor does so, Sponsor will post notice of its action at the Event.
11. Personal Information:Any personal information supplied by you to the Promotion Entities will be subject to Sponsor’s privacy policy and will not transferred or sold to any other outside entity.
12. General:By accepting a prize, the winner grants to the Promotion Entities the right to use winner’s name, likeness, image, voice, hometown and biographical information in advertising, trade and promotion, including on the Internet or via wireless application protocol, without further notice, compensation or permission, except where prohibited by law. Government employees who win a prize may be subject to ethics and gift rules of their jurisdiction.

By playing, entrants agree to release, waive and hold harmless Promotion Entities from any and all injuries, claims, damages, losses, costs, or expenses of any kind (including without limitation attorney’s fees) resulting from the entrants’ participation in this Promotion, their acceptance, use, or misuse of any prize or element thereof, and any travel or event-related activity in connection with the Promotion. Neither the failure of Sponsor to insist upon or enforce strict performance of any provision of these Official Rules or the failure, delay or omission by Sponsor in exercising any right with respect to any term of these Official Rules, will be construed as a waiver or relinquishment to any extent of Sponsor’s right to assert or rely upon any such provision or right in that or any other instance. If there is a conflict between any term of these Official Rules and any entry or marketing materials used in connection with this Promotion, the terms of the Official Rules will govern.

Sponsor reserves the right to disqualify any individual from further participation in the Promotion if Sponsor concludes, in its sole discretion, that such person: (a) has attempted to tamper with the entry process or other operation of the Promotion; (b) has disregarded or has attempted to circumvent these Official Rules; (c) has committed fraud or attempted to undermine the legitimate operation of the Promotion; or (d) has acted toward any Promotion Entity or any other entrant in an unfair, inequitable, deliberately annoying, threatening, disrupting or harassing manner. Tampering includes attempting to enter more than the number of times permitted herein, including through the use of any prohibited device or method.

By participating in the Promotion, entrants agree that: (a) any and all disputes, claims, and causes of action arising out of or connected with the Promotion, or any prizes awarded, will be resolved individually, without resort to any form of class action; (b) any and all claims, judgments and awards will be limited to actual out-of-pocket costs incurred, including costs associated with participating in the Promotion but in no event attorneys’ fees; and (c) under no circumstances will any entrant be permitted to obtain any award for, and entrant hereby waives all rights to, claim punitive, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than for actual out-of-pocket expenses.

This Promotion will be governed by the laws of the State of Florida, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other state’s laws. Venue for any action concerning the Promotion or these Official Rules will be in the state courts of Florida or federal court located in Florida.

13. Winner List:You may request the name of the winner by sending a self-addressed, stamped envelope with the name of the THE TUNING SCHOOL LS FEST TUNING PACKAGE GIVEAWAY on the envelope and addressed to: The Tuning School, Attn: Accounting, 2328 Destiny Way, Suite A, Odessa, FL 33556. Requests must be received no later than October 31, 2019.
